Information on legislation
– The Civil Code expresses Art. 481 says that any contract of sale, should include: one party that is obliged to transfer ownership of an asset and the other party, that pays for it in money.
– Requirements for the purchase contract to be valid: specifying the property in the essential clauses of the contract and the identification of both parties, a complete description of the property, the price of the property, the payment method, a decision about the authority in case of conflict resolution, cancelation and fines when non-compliance occurs, additional annexes and
guarantees.
-For a foreigner to buy property in Brazil, he must have a valid and regularized CPF in the country (Cadastro de Pessoa Física or a registration of a physical person). To issue the document it is necessary to fill out a simple form of the Federal Treasury, presenting your passport or National Registry of Foreigners (RNE).
– LAW N° 5,709/71, Art. 1 says foreigners residing in the country and foreigners living outside Brazil are authorized may acquire rural properties as specified by this Law.”
– According to data from the Organization for Economic Cooperation and Development (OECD) and the Central Bank, Brazil was the fourth country with the highest volume of foreign investments in the first quarter of 2022. And the real estate market is among those investments, since that has a safe and profitable outcome. – Taking this into account, this article also discusses the possibility of foreign real estate investors applying for a residence permit in Brazil. The requirements are established in Resolution No. 36/2018 of the National Migration Council.
– The Ministry of Justice and Public Security can grant a residence permit to people who wish to invest in real estate in Brazil as long as the money comes from their own resources and from outside of the country. Note that the payment has to come from a bank outside the country with a statement of its origins, to make sure it is not a part of money laundering deals.
– Required investment values for residency:
Investment of at least R$ 700,000.00 (seven hundred thousand reais) in the acquisition of real estate either built or under construction, in urban areas of the North and Northeast regions of the country. Investment of at least R$ 1,000,000.00 (one million reais or 187,000 US$ ) in the acquisition of real estate either already built or under construction, in urban areas of other regions of Brazil.
